    • -Does not constitute a crime so no jail
    • -fine not more than $300
  2. Misdemeanor
    • -sentence not more than 90 days
    • -fine not more than $1000
    • -or both
  3. Gross misdemeanor
    • -Sentence not more than 1 year
    • -fine not less than $1k not more than $3k
    • -or both
  4. Felony
    • -sentence not less than 1 year

  5. DUI aiding and abetting
    passenger can be charged if knows that driver is intoxicated
  6. commercial vehicle DUI
    • -alcohol limit .04
    • -can have vehicle put on 24hr out of service order if any alcohol in system

    • -felony

    • -one aggravating factor
    • -refusal to submit to chemical test

    • -No aggravating factor
    • -Misdemeanor
  11. DUI aggravating factors
    • -Qualified DUI incident within 10 years
    • -BAC .20 or more
    • -child under 16 YO in if not less than 36 months younger than offender vehicle while DUI
